WoodworkerExpress.com (“WWE”) provides a large selection of woodworking, cabinet and furniture tools and supplies to meet the needs of all businesses, trade professionals, homeowners, and Do-It-Yourself (DIY) weekend warriors. At WWE, it is our mission to provide exceptional customer service in a convenient, online environment.

By using the website for WWE, You agree to these Terms and Conditions, so please take a moment to review them carefully.

Electronic Communications:
In order to purchase a product from the Website, all Users must create an account. When you, as a User, (“You”) browse the Website, create an account on the Website or purchase a product from WWE or send an e-mail to WWE, from a desktop, laptop, mobile or other connected device (“Device”), You are agreeing to be bound by these Terms and Conditions. Upon ordering a product from WWE, you are explicitly consenting to WWE’s use of your personal data provided to us in order to fill the order. Please see WWE’s Privacy Notice for further information regarding your personal information.

By creating an account, You consent to receive communications from WWE electronically. WWE communicates with you by e-mail and sometimes by phone, or by posting notices and messages on the Website. You agree that all agreements, notices, disclosures, and other communications that WWE provides to You electronically satisfies any legal requirement that such communications be in writing.

Order confirmations and statuses will be sent to You electronically by email. These order emails from our system are separate from marketing and promotional emails.

If You do not want to receive e-mail from us regarding new products and services, promotions, upcoming events, special offers and new Website features, please click the “Unsubscribe” link at the bottom of any email you receive from us or send an email to webmaster@woodworkerexpress.com and request to be removed from WWE’s promotional email list. WWE will do everything in its power to promptly honor your opt-out email request.

Please note that it may take up to twenty four (24) hours for an opt-out request to be fully processed and therefore, within this timeframe, you may still receive marketing emails and notifications from WWE.

Representations:
WWE’s online catalog was compiled from information and data furnished by the various manufacturers whose products appear herein, and WWE assumes no responsibility nor makes any representations as to the accuracy of the specifications or descriptions of the products. All illustrations and descriptions are for the sole purpose of identification, and WWE does not represent that the products will necessarily conform to the illustrations or descriptions.

WWE disclaims any responsibility for direct, indirect, consequential or exemplary damages to the purchaser or any other person for injury to person, or damage to or loss of property, or damage to business, or loss of use of property caused by any goods sold, leased, or repaired by WWE.

WWE assumes no liability for damages or any other expenses incurred as a result of improper materials shipped or because of delay in shipment, or through failure to ship, or for non-delivery of goods on a specified date due to fire, flood, strikes, accidents, government negotiations, delay of carriers, or other causes beyond our control.

Limited Warranty:
All Products available for purchase from WWE are provided on an "as is" and “as available” basis, unless otherwise specified in writing. WWE MAKES NO WARRANTY, EXPRESS OR IMPLIED, AS TO MERCHANTABILITY OF GOODS ILLUSTRATED AND DESCRIBED IN THIS CATALOG OR THAT SUCH GOODS ARE FIT FOR ANY PARTICULAR PURPOSE. Any warranty offered by a manufacturer applies and extends only to the original purchase of new products.

Limitation of Liability:
WWE’s liability for damages, including direct and indirect as a result of a breach of manufacturer's warranty, shall not exceed such manufacturer's warranty.

Copies of warranties are available and will be furnished to customers upon request.

License:
Subject to your compliance with these Terms and Conditions, WWE grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of WWE through its Website. This license strictly prohibits any resale or commercial use of any of the Products purchased sold by WWE. The license does not include any collection or use of any content on the Website, including but not limited to Product descriptions, use of any trademarks or trade names, any derivative use of any content provided by the Website. All rights not expressly granted to You in these Terms and Conditions are reserved and retained by WWE, its suppliers, rights holders, or other content providers. You may not frame, or using any framing techniques to enclose any trademark, logo, or other proprietary information including images, text, page layout or form of WWE without express written consent. You may not utilize any meta tags or any other “hidden text” containing WWE’s name or trademarks without the express written consent of WWE. If You violate these Terms and Conditions of WWE, the license granted by WWE herein shall terminate immediately without further notice to You.

Ordering Merchandise:
WWE can provide its best service, with the least amount of errors, to You if You provide complete information upon placing an order. For instance, please specify WWE item numbers, quantities desired, catalog numbers, sizes, dimensions, figure numbers, and styles in Your order.

Shipment Claims:
When You receive a shipment from WWE, You are responsible to check each shipment to ensure that Your delivery accurately reflects the products You ordered. Our policy is that You must report delivery errors within seven (7) days of receipt of such items (“Receipt Period”) unless otherwise noted in the product description. If notified of a shortage or damaged delivery within the Receipt Period, WWE will send additional products or replacement products to You at no charge. If WWE is not notified of any shortage, damaged product or any other error in delivery within the Receipt Period, then WWE will not correct any such errors.

Shipping Methods:
All orders are shipped via UPS Ground to all destinations in the United States. Please note that UPS will not ship to a P.O. Box and all shipments are required to have an actual street address.

Shipments to some locations, including but not limited to Alaska, Hawaii, and Puerto Rico, are shipped via UPS and will incur additional freight charges. You will be notified of the freight costs, and if you accept, You will be charged accordingly. In rare circumstances, due to an unforeseen data error or other circumstance beyond our control, products may be unavailable or prohibitively expensive to ship. Under such circumstances, we will contact You to advise You of the same and to offer any viable alternative arrangements. If merchandise needs to be shipped Next Day Air or Second Day Air, You will be charged an actual freight fee as quoted during the checkout process. All Next Day Air or Second Day Air orders should be placed before 3:00pm (US Central Time) to be delivered as requested. You will receive a shipping notification via e-mail containing the time your order was shipped along with carrier used and tracking number if applicable.

International Shipments (Outside the continental U.S.):
All international orders are processed and fulfilled through i-Parcel, a subsidiary of UPS. Shipping costs and methods are determined by i-Parcel / UPS as appropriate per country to get the shipment to the shipping address in the most economical manner possible. All shipping charges, taxes, duties and brokerage fees (if applicable) will be determined during the checkout process. All charges shown on the Order Confirmation are the true charge amounts and will not change. PRO Membership:
The Woodworker Express PRO Membership Program (“Pro”) is an annual prepaid fee shipping program providing unlimited free standard shipping for twelve (12) months from the date of purchase. The cost of the yearly membership is $100 USD plus tax. Membership covers standard freight charges only. Air shipments, LTL/3rd party shipments and/or additional box fees charged for large packages are not included in the free standard freight membership. Pro is only available in the U.S. 48 contiguous States. WWE reserves the right, at its discretion, to cancel a Pro membership at any time and provide the customer a full refund of the original $100 purchase price.

Returns:
If you are not 100% satisfied with your purchase, you may return the item(s) at Your cost within 30 days of shipment for a full credit or exchange, provided the product is undamaged. All returns will be a subject to a restock fee.

Disputes:
If You have a dispute or claim relating in any way to Your use of the Website or WWE, or to any products sold by WWE or services provided by WWE, such disputes or claims shall be resolved exclusively by binding arbitration located in Wisconsin provided however, that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this Agreement.
